Welcome to Whisker Atelier!

These Terms of Service ("Terms") govern your access to and use of the Whisker Atelier website (the "Service"), operated by The Hue Map Ltd, trading as Whisker Atelier ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. Use of the Service

1.1. Eligibility: You must be at least 18 years old to use this Service. By using the Service, you confirm that you are at least 18 years old.

1.2. Account: To access certain features, you may need to create an account. You are responsible for keeping your account details and password confidential.

2. Products

2.1. Product descriptions: We sell fine art prints, canvases, framed prints and custom pet portraits. We work hard to describe and display our products accurately, but colours may vary slightly due to screen settings and print processes.

2.2. Pricing: Prices are shown in the currency of your region and may change without notice. We reserve the right to modify or discontinue any product at any time.

2.3. Made to order: Our products are printed on demand by our production partners. Production typically takes 2–3 business days before dispatch.

3. Custom pet portraits

3.1. Your photos: When you upload a photo for a custom portrait, you confirm that you took the photo or have permission to use it. We use your photo only to create your portrait and fulfil your order.

3.2. Artistic interpretation: Each portrait is an artistic interpretation of your pet. We aim to preserve your pet's features, markings and personality, while the pose, composition and setting may be refined to create a stronger finished artwork. Portraits are created by our studio using digital tools, which may include AI-assisted imaging.

3.3. Your order: Please check your photo, size and finish carefully before ordering. We begin creating your portrait once your order is placed, and it is printed in the size and finish you selected.

3.4. Showcasing your portrait: We may ask whether we can feature your finished portrait on our website or social media. We will not do so without your permission.

4. Ordering and payments

4.1. Orders: By placing an order, you are making an offer to purchase products in accordance with these Terms. We reserve the right to refuse or cancel orders at our discretion.

4.2. Payment: We use secure third-party payment processors for all transactions. By providing your payment information, you confirm that you have the legal right to use the payment method provided.

4.3. Order confirmation: You'll receive an email confirmation once your order has been placed. This does not constitute acceptance of your order — acceptance occurs when your order is dispatched.

5. Shipping and delivery

5.1. Delivery: We offer free delivery on many orders to a wide range of destinations. Where shipping costs apply, they are clearly displayed at checkout before you complete your purchase. Estimated delivery times vary by destination — please see our Shipping Policy for full details.

5.2. Customs and import taxes: International orders may be subject to customs duties or import taxes set by your country. These charges are your responsibility and are not included in your order total.

5.3. Delivery address: You are responsible for providing an accurate delivery address. We are not liable for orders lost or delayed because of incorrect address information provided at checkout.

6. Returns and refunds

We have a 30-day return policy for art prints, canvases and framed prints. Because custom pet portraits are personalised and made to order, they can't be returned for a change of mind. Please see our Refund Policy for full details.

7. Intellectual property

7.1. Ownership: All content on the Service, including text, graphics, logos, images, artwork, product designs and software, is the property of The Hue Map Ltd and is protected by intellectual property laws.

7.2. Copyright notice: Copyright © The Hue Map Ltd, trading as Whisker Atelier, 2026. All rights reserved. No part of any artwork or product sold by Whisker Atelier may be reproduced, distributed or transmitted in any form or by any means without our prior written permission.

7.3. Custom portraits: Your custom portrait is for your personal, non-commercial use. You may display it and share photos of it, but you may not reproduce it for sale.

7.4. Licence: You are granted a limited, non-exclusive, revocable licence to access and use the Service for personal, non-commercial use only.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use your information, including photos you upload.

9. Limitation of liability

9.1. Disclaimer: To the extent permitted by law, The Hue Map Ltd disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

9.2. Limitation: The Hue Map Ltd shall not be liable for any indirect, special, incidental, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Consumer rights

If you are a consumer based in the United Kingdom or European Union, you have statutory rights that cannot be excluded or limited by these Terms. Nothing in these Terms affects those rights.

12. Changes to these Terms

We may modify or replace these Terms at any time. Changes take effect when posted on the Service, and your continued use of the Service after any changes means you accept the updated Terms.
